Terms of Service

1. Definitions

• “Platform” refers to lmarcade’s website, applications, and services.
• “User” means any individual or entity that accesses or uses the Platform.
• “Content” includes text, graphics, images, games, information, and materials made available on the Platform.
• “Game” means an AI-generated browser game presented for evaluation on the Platform.
• “Vote” means a comparison or rating you submit between Games.
• “Submission” means any prompt or other content you submit through the Platform.
• “Dispute” means any disagreement or claim arising from or related to these Terms.

2. Eligibility

To use the Platform, you must:

• Be at least 18 years old;
• Have the legal capacity to enter into binding contracts;
• Not be prohibited from using the Platform under applicable laws;
• Maintain accurate and current registration information; and
• Not have been previously suspended or removed from the Platform.

3. Account Registration and Security

Voting requires signing in through a supported identity provider (currently Google). You are responsible for all activity occurring under your account, for maintaining the security of your sign-in credentials, and for any content submitted through your account. You agree to provide accurate information, not to share your credentials, not to impersonate others or create accounts through unauthorized means, and to notify us promptly of any unauthorized access.

4. Platform Rules and Guidelines

4.1 Prohibited Activities. You agree not to, and not to attempt to:

• Violate any applicable laws or regulations, or infringe the rights of others;
• Manipulate, rig, or game voting or rankings, including through automated voting, bots, scripts, multiple or fake accounts, coordinated brigading, or buying or selling votes;
• Scrape, crawl, harvest, mirror, or systematically extract Content, game source, or data except as expressly permitted in writing;
• Reverse engineer, decompile, deobfuscate, disassemble, or otherwise attempt to derive, reconstruct, copy, or redistribute the source code or assets of any Game or of the Platform;
• Circumvent, disable, or interfere with security, rate-limiting, content-protection, or access-control features, or access the Platform or its APIs other than through the interfaces we provide;
• Probe, scan, overload, disrupt, or introduce malicious code to the Platform;
• Submit false or misleading information, or harass, abuse, or harm others; or
• Use the Platform for any fraudulent or illegal purpose.

4.2 Content Guidelines. Any Submission must be lawful and professional; must not be discriminatory, offensive, harassing, deceptive, or harmful; must not contain malicious code, spam, or unauthorized advertising; must not infringe intellectual property or other third-party rights; and must not impersonate others.

5. The Service and Voting Integrity

lmarcade is a public, blind, head-to-head arena in which Users compare and vote between AI-generated browser Games, and votes are aggregated into model and harness rankings. The identities of the systems behind individual Games are withheld during voting and may be revealed only after a Vote is cast. To preserve fairness, we may weight, discount, delay, or discard Votes; rate-limit activity; require minimum engagement; and detect and act on suspected fraud or abuse, in our sole discretion. Rankings are provided for informational and entertainment purposes, may change as data accrues, and are not guaranteed to be definitive or error-free. We may add, modify, suspend, or discontinue any part of the Platform at any time.

6. Intellectual Property Rights

6.1 Platform IP. The Platform and its original content, features, and functionality — including its software, design, user-interface elements, proprietary algorithms, the lmarcade name and mascot, branding and trademarks, the Games, and associated assets — are owned by AfterQuery or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use (namely, to view and play Games within the Platform and to vote). You may not copy, modify, distribute, host, publicly perform, or create derivative works from the Platform or Games without our express written permission.

6.2 User Content. You retain ownership of your Submissions but grant AfterQuery a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, store, reproduce, modify, adapt, distribute, and display your Submissions as necessary to operate, improve, and promote the Platform. You represent that you have all rights necessary to grant this license and that your Submissions do not violate these Terms or any law. The Games and certain other Content are generated by AI systems and are provided “as is”; they may be incomplete, inaccurate, or non-functional, and you use them at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, AfterQuery shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Platform, any unauthorized access to your data, the conduct of third parties, service interruptions or technical issues, the quality or behavior of AI-generated Games, disputes between Users, or loss of profits, data, or goodwill. Our total liability for all claims relating to the Platform shall not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Term and Termination

We reserve the right to suspend or terminate your access, remove any Content you submit, take appropriate legal action, report violations to authorities, block access from specific locations, and modify or discontinue the Platform, with or without notice. Upon termination, all licenses and rights granted to you cease, you must stop using the Platform, your account may be deactivated, and provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnification) will survive.

9. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes through email notifications at least 30 days before the changes take effect, Platform announcements, website updates, and/or an update to the “Last updated” date above. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms. If you disagree with any changes, you should stop using the Platform and may contact us to request deletion of your account.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes shall be resolved in the courts of San Francisco County, California, and you consent to the personal jurisdiction of such courts. For any claims not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts located in San Francisco County, California.

11. Dispute Resolution

Before filing any legal action, you agree to:

• Attempt to resolve disputes through direct negotiation;
• Participate in mediation if requested;
• Submit to binding arbitration for claims under US$10,000;
• File claims within one year of the dispute arising;
• Not participate in class actions; and
• Not seek punitive damages or attorney’s fees unless awarded by law.
